CBD is available in a variety of formulations and products and is sold by countless companies. Now leading experts at Harvard Medical School are here to help you separate fact from frightening fiction about medical cannabis so you can make informed decisions. With so much misinformation and junk-science on the internet, it is important to get solid facts from doctors and scientists you can trust before deciding if medical marijuana could help you. Food companies that wish to use cannabis or cannabis-derived ingredients in their foods are subject to the relevant laws and regulations that govern all food products, including those that relate to the food additive and GRAS processes. “It is critical that consumers know and trust that the new, legal cannabis market offers tested products and follows protocols designed to protect public health,” said Tremaine Wright, chair of the Cannabis Control Board. It remains uncertain as to whether Commerce Clause violations are applicable to markets and products that are still illegal under federal law. Meanwhile, the law is very unsettled on residency requirements with many experts believing that until marijuana is legalized nationally, the Commerce Clause does not apply and cannot be violated because there is no legal interstate commerce of cannabis – a drug illegal under federal law. Plaintiffs also ask the court to rein in defendants and require them to cease applying MRTA regulations applicable to marijuana retailers during inspections of lawful licensed hemp retailers selling legal hemp products. Cannabis marketed as “recreational” typically contains high concentrations of THC, often with very little CBD. Through selective breeding and indoor cultivation, THC’s concentration in cannabis strains used specifically for intoxication has increased dramatically in recent years (ElSohly et al., 2016). Cannabinoids and terpenes are produced in resin-filled trichomes, small hair-like growths located most abundantly in the flowers of unpollinated female cannabis plants. If you try a cream and find it isn’t providing the support you hoped for, or if you experience any unwanted side effects, stop using it and let your doctor know. This is especially important if you have underlying health conditions or are taking other medications. According to the Arthritis Foundation, CBD can interact with some common medicines, including certain blood thinners, steroids, and even over-the-counter pain relievers. CBD can potentially interact with other medications, such as antiepileptic drugs, antidepressants, and opioid analgesics. One trial suggested an increased risk of liver injury among people using other epilepsy drugs (valproate and clobazam), but a later study did not. Here is a list of a few potential risks and side effects that come with CBD. Their ability to keep their emotions in check, and to get or excel at a new job improved, along with their mental health. Under the FD&C Act, any product intended to have a therapeutic or medical use, and any product (other than a food) that is intended to affect the structure or function of the body of humans or animals, is a drug. There are no other FDA-approved drug products that contain CBD. Aside from Epidiolex, are there other CBD drug products that are FDA-approved? FDA treats products containing cannabis or cannabis-derived compounds as it does any other FDA-regulated products — meaning they’re subject to the same authorities and requirements as FDA-regulated products containing any other substance. The 2018 Farm Bill, however, explicitly preserved FDA’s authority to regulate products containing cannabis or cannabis-derived compounds under the FD&C Act and section 351 of the Public Health Service Act (PHS Act). While gifting or transferring cannabis under the possession limit between adults who are 21 years or older without any money paid or services provided is legal. I also wanted to share that any unlicensed sale or distribution of cannabis remains illegal. However, they are not licensed, nor are they selling regulated products. October 26, 2021 – The gifting of limited amounts of marijuana between adults is not illegal in New York, unless the gifting is part of another transaction. Others talked about the quality control for the products that licensed dispensaries would provide versus whatever was currently being sold on the streets. You may see them referred to as “marijuana doctors” or “medical marijuana clinics.” But you can also find physicians who specialize in providing access to medical cannabis. The person providing certification is usually a physician (M.D. or D.O.), who confirms that you have a qualifying condition—a health problem with symptoms that could, hypothetically, be alleviated by cannabis. Whether you can access medical cannabis depends on what state you live in. Do the products you might use even contain the ingredients they promise? As of this writing, 41 states have passed legislation to allow them to take advantage of hemp pilot programs under the 2014 Farm Bill.23 Many of these programs authorize commercial sales and marketing of resulting hemp-derived CBD products by private actors licensed to do so. Marijuana itself remains illegal at the federal level in the U.S., although it has been allowed for medical and recreational use in many states, including use in pot-laced food and drinks. The agency also denied three petitions from advocacy groups that had asked the agency to allow products that contain the hemp ingredient to be marketed as dietary supplements. "It is not apparent how CBD products could meet safety standards for dietary supplements or food additives," FDA Deputy Commissioner Dr. Janet Woodcock said in a statement. CBD is just one of dozens of cannabinoids found in cannabis, including tetrahydrocannabinol (THC), which is the one responsible for marijuana’s famous high. For now, it is crucial to stick with CBD products like CBD tinctures and topicals that we know are safe and accepted legally. This means that is currently illegal to market CBD as a dietary supplement or anything of the like. Thankfully, we are starting to get some answers that can help us navigate through the confusion, enabling us to figure out what CBD really does, how it can benefit our health and what products are just a waste of… Items containing CBD, or cannabidiol – the non-intoxicating compound derived from cannabis plants – are touted to stave off wrinkles, improve sleep, reduce anxiety, ease menstrual cramps, prevent hair loss and more. “The contaminants found in CBD products, which don’t contain what they say they contain,” she says, adding that toxicologists found evidence of pesticides, heavy metals, bacteria, and other compounds in widely available products. Bonn-Miller also explained that it's imperative to exhaust the traditional and established front-line treatments that are available before seeking out these products. And the products on the shelf aren't all the same, Ward said. For cannabis and cannabis-derived products, including cannabidiol (CBD), the process is the same as for any other drug product. Despite this recent action from the FDA, hemp-derived CBD remains a legal product under federal law, but it must be marketed without violating the FDCA. As of mid-December 2021, the FDA has only approved one cannabis-derived and three cannabis-related products, all of which you can safely get with a prescription from a licensed healthcare provider. Instead, the FDA called on Congress to create new rules for the massive and growing market for hemp- or marijuana-derived products, which have become increasingly popular in lotions, tinctures and foods and is projected to reach sales of $22 billion by 2030. Once fully implemented, the 2018 Farm Bill will legalize the cultivation of hemp and hemp-derived products and will remove its constituents (including CBD) from the list of substances scheduled under the federal Controlled Substances Act (Agriculture Improvement Act of 2018, 115 P.L. 334, 132 Stat. 4490 ).

  • As mentioned earlier, this type of marketing is not allowed since CBD is an active ingredient in an FDA-approved drug.
  • We conclude that further research is necessary to clarify legitimate therapeutic effects of CBD.
When pesticide contamination does occur, high heat used during the extraction process or during vaping may alter the chemical composition of the pesticide, which could change its toxicity profile—a problem that does not typically occur with pesticides and food crops. A final consideration related to the absence of effective CBD regulation is product contamination. When treatment with CBD does not achieve the desired results, the primary losses may be time and money; however, if a consumer chooses to use CBD to treat a serious or potentially terminal condition (e.g., cancer), the consequences may be correspondingly more severe, including progression of the disease or death. Another study found that CBD concentration was not consistent across batches of the same product purchased at different times, which conceivably could complicate dosage decisions for treatment of a chronic condition (White, 2019). Alternatively, CBD marketers may refer to other websites that promote CBD use for various conditions but do not sell it.

The participants were told that they needed to provide additional information by Nov. 12 including their names, addresses, phone numbers and the general mission of their practice or business. November 10, 2024 – Hopes for rescheduling of cannabis before year-end were dashed when Chief Administrative Law Judge (ALJ) John Mulrooney found fault with the DEA’s list of witnesses. Legalization at the federal level may have stood more of a chance under a Harris administration. Early discussions indicate that each event would require the sale of product from at least three cultivators and one retail licensee to qualify. Cannabis Growers Showcases may only be held on premises in municipalities that have not opted-out of allowing cannabis retail dispensaries to operate within their jurisdiction pursuant to Section 131 of the Cannabis Law. In other words, unless you are an approved licensee with an approved and operating retail location, you can’t participate. A Conditional Adult-Use Retail Dispensary (CAURD) licensee or an Adult-Use Conditional Cultivator (AUCC) licensee may apply to be a Cannabis Grower Showcase Organizer (CGSO) for a Cannabis Grower Showcase or “CGS”, granting them authorization for temporary retail sales at an approved location. Army veteran and one of the plaintiffs, said in a statement issued by a public relations firm announcing the lawsuit. And Chili And Cannabis Gummies A group of New York-affiliated medical cannabis operators filed a complaint against the state’s regulators asking the Court to open available licensing options to all retail dispensary applicants – not just those with prior marijuana convictions. By decoupling the state tax code from the federal law for purposes of 280E, New York-licensed cannabis businesses would see significant tax savings beginning in tax year 2023. If Congress wants to get serious about supporting small businesses and ending the illicit cannabis market, it is commonsense that we allow legal cannabis operations to deduct business expenses, just like any other industry.” “To bolster the public health and safety of all New Yorkers, we are providing them with information they need to make informed decisions and enjoy cannabis responsibly,” Governor Hochul said.

December Health Tips for People Living with Chronic Illness

The federal law sets a strict limit of the amount of tetrahydrocannabinol (THC) hemp products can contain. Sounds like a non-sequitur, but a provision in the bill to re-open the government stiffened restrictions on hemp-derived THC, a form of cannabis containing a psychoactive compound, a product that has formed the basis of a multi-billion dollar industry of essentially unregulated food and beverages. In a lawsuit filed last week NYMCIA asked a court to compel OCM and CCB to “fulfill their legal responsibility to thwart the influx of illicit cannabis product” and “to identify and sanction the companies responsible for the illegal ‘inversion’ of out-of-state cannabis products into New York.”

Citizen Petitions for Marketing CBD Products as Dietary Supplements

Still, most people who use or have used cannabis do not go on to use other substances later in life.71 Research shows that behavioral interventions such as cognitive behavioral therapy, motivational enhancement therapy, and contingency management can be effective in treating cannabis use disorder.68 Read more about behavioral treatments for substance use disorders on the National Institute of Mental Health website. One study estimated that 12.1% of people who frequently use cannabis experience cannabis withdrawal.66 Withdrawal symptoms may include anger, irritability, aggression, feeling nervous or anxious, restlessness, decreased appetite or weight, depression, insomnia, experiencing strange or unsettling dreams, headaches, sweating, abdominal pain, and tremor. A person may have withdrawal symptoms after stopping or significantly decreasing heavy or long-term cannabis use, even if they don’t have cannabis use disorder. Positive urine tests have been reported in children exposed to secondhand cannabis in their homes or in attached homes,59 which can lead to respiratory infections.60 In the United States, CBD’s current legal status is in flux because of complex and conflicting laws and a multilayered system of federal and state regulation. Because CBD is extracted from a plant, it is also susceptible to sources of unintentional contamination that may occur with plant-based products, including the introduction of pesticides, heavy metals, and microorganisms (e.g., bacteria, fungus) (Dryburgh et al., 2018; Lenton, Frank, Barratt, Potter, & Decorte, 2018; Roberts, 2019). Residual solvent or its byproducts, including carcinogenic polycyclic aromatic hydrocarbons, are contaminants identified in CBD products that likely result from insufficient removal of the solvent extractor (Romano & Hazekamp, 2013; White, 2019). Even for products that do contain reliable quantities of CBD, however, concentrations may not be high enough to produce the desired pharmacological effects, especially with oral consumption (see discussion of bioavailability in previous section). The legality and availability of CBD depend on the source and state laws. "There's a misconception that CBD and medical marijuana are the same thing and that's not the case," says Dr. Jeffrey Chung, director of the Cedars-Sinai Epilepsy Program. "We're not here to say no. We're here to help guide you toward safe and effective healthcare decisions." Some states have legalized recreational use of marijuana, while others have legalized medical marijuana. The law depends on where you live, and whether the CBD comes from hemp or marijuana. But whether or not these products actually contain the amount of CBD they advertise is up for debate, since they're not approved by the FDA. For example, the law precludes manufacturers and distributors from selling mislabeled or adulterated products and it requires manufacture and sale of products consistent with good manufacturing product standards. Most CBD-infused products are marketed as supplements, which are not regulated by the FDA. It seems like everywhere you look, products infused with cannabidiol, better known as CBD, are being advertised as the latest and greatest wellness product. As noted, demonstrating a product's intended use and making disease and health claims are common pitfalls for companies selling CBD products.
The Healthy
The use of cannabis during pregnancy may have harmful effects on a baby’s health after birth. Research has linked the use of cannabis products with an increased likelihood of developing head, neck, or throat cancer,40 particularly in people who smoke cannabis.41 These effects are more common when a person takes a large amount, the cannabis product is strong (has a high level of THC), or the person has little experience with using cannabis.19,20,21 There is limited research on the health effects delta-8-THC and other intoxicating cannabinoids and related compounds, including delta-10-THC, THC-O-acetate, THCV, THCP, HHC, HHC-O-acetate, HHCP, and CBN. Delta-8 THC products have not been FDA-approved for safe use. An experienced healthcare attorney understands the applicable federal, state, and local laws. Are you thinking of cultivating or selling hemp or marijuana to make CBD and THC infused products? A key factor in obtaining approval of these new marijuana-based products is validating the effectiveness of the drug through accepted clinical research. Hence, consumers should not assume that consumption of CBD in a food or beverage product is recognized by the FDA as safe. In the United States, the classification of “hemp” is restricted legally to plants that contain less than 0.3 percent THC, although the CBD concentration of hemp is not controlled. In contrast, “hemp” that is selectively bred for consumer use may have resin-rich flowers that contain high concentrations of CBD (acid form), and the flowers of cannabis plants bred for recreational use usually contain high concentrations of THC (acid form) (Andre et al., 2016; VanDolah, Bauer, & Mauck, 2019). The degree to which the blend of chemicals contained in a cannabis strain contribute to its pharmacological or therapeutic effects directly or through modulation of the activity of THC or CBD (i.e., the “entourage effect”; Russo, 2011) is an area of active research and has not yet been resolved. Cannabis (and its extracts) marketed as “medical” may contain THC, CBD, or a combination of both, as well as other minor cannabinoids and terpenes. “This modification to income is appropriate because, while the expenses of cannabis-related business cannot be deducted for federal purposes, New York law permits and encourages these businesses akin to any other legitimate business occurring in the State,” a memo attached to the bill says. In June, New York’s Office of Cannabis Management proposed allowing ROs/MSOs to enter the recreational retail market by year-end, reversing itself on the promised three-year waiting period for the state’s 10 vertically integrated medical marijuana providers. The showcases broadened the availability of cannabis products throughout the state and enabled buyers to purchase cannabis products in areas where no retail outlets were open, and where none could open because of litigation that stalled the opening of new retail outlets. January 15, 2024 – PharmaCann is the only medical operator to open a co-located store in the state.Although six cannabis multistate operators were approved by New York regulators to open retail shops, only one has so far taken the plunge. In response, the FDA pointed out, in its latest report to Congress, that the (woefully inadequate) Dietary Supplement Health and Education Act posed a number of challenges to successfully introducing CBD into the dietary supplement market. Regulatory certainty will allow the legal hemp industry to flourish while opening up exciting new economic opportunities for farmers and entrepreneurs in a way that protects the public. Members of Congress wrote the FDA as well, urging it to “act quickly to provide legal clarity” in light of “growing consumer demand and the expected surge in hemp farming in the near future”. For our current health coverage please visit the Health section. Today, January 26th, the FDA released a statement concluding that the current regulatory framework for food and supplements are simply not appropriate for CBD! Rep. James Comer, the chair of the US House Oversight Committee, commented recently that that the committee desires to question the current FDA Commissioner Robert Califf regarding the agency’s lack of movement on a number of issues, including CBD. In other words, GW Pharmaceuticals may now lawfully distribute CBD made from the buds or leaves of the Cannabis plant; it just can’t produce (or even possess) those buds and leaves here in the United States. Oddly, however, the company likely cannot manufacture the drug yet, at least not in the United States. To be sure, there was some uncertainty over just how far the DEA would go—for example, would it reschedule just Epidiolex, or would it reschedule all CBD based drugs? Even after the approval, the company that makes Epidiolex (GW Pharmaceuticals) still couldn’t lawfully sell it. (Senate Majority Leader Mitch McConnell has proposed legislation that would remove many of these restrictions on hemp, see here, but it remains just a proposal for now.) The FDA’s approval of Epidiolex did not, by itself, make it lawful to possess or distribute CBD under federal law. (The FDA had previously approved two synthetic forms of THC for medical use.) The FDA got the ball rolling in June 2018, when it approved a drug (Epidiolex) made from natural CBD—i.e., CBD extracted from the Cannabis plant (any part). Given these limitations imposed on industrial hemp, I suspect the Agricultural Act does not create much of an opportunity to produce (and especially, to sell) CBD legally. Perhaps most importantly, the Act authorizes only the production of industrial hemp—and then only for research purposes.

Studies have shown evidence of liver toxicity, interactions with certain medications, and possible harm to the male reproductive system. Specifically, during an April 11, 2024 hearing before the House Oversight and Accountability Committee, FDA Commissioner Califf stated “the use of CBD raises safety concerns, especially with long-term use. "But it is less clear how this risk might be managed if this substance is used far more widely, without medical supervision." You need a doctor's prescription to get this medication, and it contains a much higher dose of CBD than what people typically get from the oils sold online or in dispensaries or markets. "We're really in the infancy of understanding the physiological effects of cannabadiol right now," says Ziva Cooper, research director for the UCLA Cannabis Research Initiative. Farmers producing hemp primarily for non-intoxicating CBD products fear the legislation will regulate them out of business and hurt the growing CBD industry for health-related products. Lawmakers say that growers and processors exploited the opportunity to formulate products with THC levels equal to those of legal cannabis. Hemp was once considered a controlled substance, but changes in the 2018 farm bill essentially opened the door to hemp-derived products, like paper, clothing and building supplies. It is a fascinating drug to study with seemingly promising potential benefits. Outside of that, CBD is reportedly used by many people across the globe for various ailments including pain relief, sleep, and general wellness. THC is short for “tetrahydrocannabinol.” Like CBD, it is another ingredient found in the cannabis plant. CBD is short for “cannabidiol.” It is the scientific name for one ingredient found naturally in the Cannabis sativa plant. It’s become a very popular product around the world. One positive business impact — marijuana firms can officially take federal tax deductions that they’ve been barred from under an Internal Revenue Service (IRS) code known as 280E. Cannabis was first listed more than 50 years ago as a strictly prohibited drug, on par with heroin and LSD and defined as a substance with no known medical value and a significant abuse potential. The lawsuit seeks declaratory relief and asks the court to invalidate the CAURD licenses issued to date, equating with the revocation of roughly 460 CAURD permits, including most of the 127 adult-use stores licensed to date. May 19, 2024 – Yet another lawsuit has been filed in State Supreme Court in Albany claims CCB acted arbitrarily, capriciously and illegally. Author Samantha Gene Baldwin, a Georgetown master of public policy student, wrote in the thesis that the findings are “surprising,” saying the links between recreational marijuana legalization (RML) and IPV “require careful consideration.” What should I do if my child eats something containing cannabis? 4, 5, 6 The American College of Obstetricians and Gynecologists (ACOG) recommends that women who are pregnant or contemplating pregnancy should be encouraged to discontinue cannabis use. 1, 2, 3 Based on published animal research, there are also concerns that use of cannabis during pregnancy may negatively impact fetal brain development. Regulations controlling the transportation and use of Schedule I drugs are strict, even when such drugs are being used for research. Although it has been increasing, rigorous research on the therapeutic effects of cannabinoids in humans remains sparse. CBD’s effects on this system are indirect at best and, as yet, have been demonstrated primarily in molecular models. Always choose reputable brands that provide up-to-date, third-party lab reports (Certificates of Analysis) for their products. It means that while the CBD oil you buy is federally legal, it exists in a largely unregulated space. While you see CBD products everywhere from online stores to local cafes, the regulatory landscape is far more complex than it appears. In December 2018, FDA announced that it had completed its evaluation of three GRAS notices related to hemp seed-derived ingredients (i.e., hulled hemp seeds, hemp seed protein, and hemp seed oil). As previously noted, FFDCA §201(g) defines the term drug to include, among other things, "articles intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in man or other animals" and "articles (other than food) intended to affect the structure or function of the body of man or other animals." An example would be a dog food containing calcium that may affect an animal's bone structure. In 2018, more than 1,000 companies were producing and marketing CBD products for the U.S. market.133 Since 2014, when total CBD sales were a reported $108 million, U.S. sales of CBD have risen fivefold (Figure 3). Typically, these products contain 0.45% to 1.5% THC, with some products containing up to 9% THC—levels that could result in psychoactive effects by the user.131 If a firm seeks to market CBD as a treatment or an otherwise therapeutic product, the firm generally would need to obtain premarket approval from FDA via the new drug approval pathway. CBD may be lawfully marketed as a drug, pursuant to FDA approval, and in compliance with applicable statutory and regulatory requirements.

Personally, I am a believer that when you look at the clinical trial process, the best place to start is by asking the question, “How are you going to market the product and what is the market going to be? The role of the FDA in regulating CBD products is both evolving and essential. The FDA continues to study potential liver damage, drug interactions, and effects on vulnerable populations like children and pregnant women. In yet another lawsuit, filed in March, a diverse coalition of interested stakeholders demanded that state regulators open up universal licenses to multistate operators that hold medical marijuana licenses in New York. It charges that the Dormitory Authority of the State of New York (DASNY), a state agency which oversees the $200 million fund, is violating federal law due to marijuana’s status as a Schedule 1 narcotic. Not all commentators at last week’s meeting were happy about the acceleration of allowing medical cannabis companies to operate fearing that allowing these large corporations to operate would give them an unfair advantage and ultimately enable them to dominate the market. Companies licensed to sell medical marijuana, after the payment of a $20 million fee, can enter the adult use recreational market as both retailers and wholesalers. “New York’s Office of Cannabis Management has had every opportunity to build on the experiences of other states’ legal cannabis markets, and instead has chosen to adopt a set of misguided regulations that, in some key respects, unduly hamstring the state’s burgeoning cannabis industry,” Leafly said in a statement. Formulations seeking approval to use other types of hemp extracts as an ingredient—including but not limited to CBD—would likely not be approved by TTB, since these extracts have not been authorized for use in food by FDA.102 Additionally, independent of CBD's status as a drug ingredient, CBD has not been approved as a food additive, and FDA has determined that "based on a lack of scientific information supporting the safety of CBD in food … it cannot conclude that CBD is GRAS among qualified experts for its use in human or animal food."101 As such, any ingredients added to alcohol beverage products must be either an FDA-approved food additive or determined to be GRAS. FDA has delayed enforcement of premarket review requirements for certain tobacco products—including ENDS—providing manufacturers more time to prepare for the review process. Some exemptions exist for provisional and branding licenses that do not touch any physical product. The court in denying Variscite’s claims also questioned if the Commerce Clause even “applies to federally illegal cannabis markets.” The system of in-state preferences has basically shut down the industry in the Hudson Valley and other areas of the state, while a federal lawsuit grinds its way through courts that are part of a system that still holds cannabis to be illegal. Despite the regulatory concerns with CBD products, there is substantial interest among consumers, as well as the medical and scientific communities, regarding the therapeutic potential of CBD, including for indications not yet approved by the FDA. Hemp-derived CBD products have become ubiquitous because they are no longer considered controlled substances, meaning they are widely available in jurisdictions in which cannabis remains illegal. Global policy changes have increased access to products containing cannabidiol (CBD), a primary constituent of hemp and cannabis. In 2016, FDA promulgated regulations (known as the deeming rule)89 that extend authority over all products meeting the definition of a tobacco product that were not already subject to the FFDCA, including ENDS. FDA may issue a regulation, after notice and comment, creating an exception that allows CBD to be marketed as a dietary supplement.76 Such a regulation may be requested by an interested person through the filing of a citizen petition.77 If an interested party has evidence challenging FDA's conclusion excluding CBD from the dietary supplement definition, the party may submit to FDA a citizen petition asking the agency to issue a regulation, subject to notice and comment, finding that the ingredient, when used as or in a dietary supplement, would be lawful. FDA does not evaluate the safety and effectiveness of dietary supplements prior to marketing; however, supplements are subject to various statutory and regulatory requirements. The FFDCA requires that all human and animal foods are safe to eat, produced in compliance with current good manufacturing practices (CGMPS), contain no harmful substances, and are truthfully labeled, among other things.34 Generally, food intended for human or animal consumption is not approved by FDA prior to marketing.
