Food companies that wish to use cannabis or cannabis-derived ingredients in their foods are subject to the relevant laws and regulations that govern all food products, including those that relate to the food additive and GRAS processes. “It is critical that consumers know and trust that the new, legal cannabis market offers tested products and follows protocols designed to protect public health,” said Tremaine Wright, chair of the Cannabis Control Board. It remains uncertain as to whether Commerce Clause violations are applicable to markets and products that are still illegal under federal law. Meanwhile, the law is very unsettled on residency requirements with many experts believing that until marijuana is legalized nationally, the Commerce Clause does not apply and cannot be violated because there is no legal interstate commerce of cannabis – a drug illegal under federal law. Plaintiffs also ask the court to rein in defendants and require them to cease applying MRTA regulations applicable to marijuana retailers during inspections of lawful licensed hemp retailers selling legal hemp products. Cannabis marketed as “recreational” typically contains high concentrations of THC, often with very little CBD. Through selective breeding and indoor cultivation, THC’s concentration in cannabis strains used specifically for intoxication has increased dramatically in recent years (ElSohly et al., 2016). Cannabinoids and terpenes are produced in resin-filled trichomes, small hair-like growths located most abundantly in the flowers of unpollinated female cannabis plants. According to the Arthritis Foundation, CBD can interact with some common medicines, including certain blood thinners, steroids, and even over-the-counter pain relievers. CBD can potentially interact with other medications, such as antiepileptic drugs, antidepressants, and opioid analgesics. One trial suggested an increased risk of liver injury among people using other epilepsy drugs (valproate and clobazam), but a later study did not. Once fully implemented, the 2018 Farm Bill will legalize the cultivation of hemp and hemp-derived products and will remove its constituents (including CBD) from the list of substances scheduled under the federal Controlled Substances Act (Agriculture Improvement Act of 2018, 115 P.L. 334, 132 Stat. 4490 ). Alternatively, CBD marketers may refer to other websites that promote CBD use for various conditions but do not sell it. In a lawsuit filed last week NYMCIA asked a court to compel OCM and CCB to “fulfill their legal responsibility to thwart the influx of illicit cannabis product” and “to identify and sanction the companies responsible for the illegal ‘inversion’ of out-of-state cannabis products into New York.” Citizen Petitions for Marketing CBD Products as Dietary Supplements Still, most people who use or have used cannabis do not go on to use other substances later in life.71 Research shows that behavioral interventions such as cognitive behavioral therapy, motivational enhancement therapy, and contingency management can be effective in treating cannabis use disorder.68 Read more about behavioral treatments for substance use disorders on the National Institute of Mental Health website. One study estimated that 12.1% of people who frequently use cannabis experience cannabis withdrawal.66 Withdrawal symptoms may include anger, irritability, aggression, feeling nervous or anxious, restlessness, decreased appetite or weight, depression, insomnia, experiencing strange or unsettling dreams, headaches, sweating, abdominal pain, and tremor. A person may have withdrawal symptoms after stopping or significantly decreasing heavy or long-term cannabis use, even if they don’t have cannabis use disorder. Positive urine tests have been reported in children exposed to secondhand cannabis in their homes or in attached homes,59 which can lead to respiratory infections.60 In the United States, CBD’s current legal status is in flux because of complex and conflicting laws and a multilayered system of federal and state regulation. Because CBD is extracted from a plant, it is also susceptible to sources of unintentional contamination that may occur with plant-based products, including the introduction of pesticides, heavy metals, and microorganisms (e.g., bacteria, fungus) (Dryburgh et al., 2018; Lenton, Frank, Barratt, Potter, & Decorte, 2018; Roberts, 2019). Residual solvent or its byproducts, including carcinogenic polycyclic aromatic hydrocarbons, are contaminants identified in CBD products that likely result from insufficient removal of the solvent extractor (Romano & Hazekamp, 2013; White, 2019). Even for products that do contain reliable quantities of CBD, however, concentrations may not be high enough to produce the desired pharmacological effects, especially with oral consumption (see discussion of bioavailability in previous section). The legality and availability of CBD depend on the source and state laws. "There's a misconception that CBD and medical marijuana are the same thing and that's not the case," says Dr. Jeffrey Chung, director of the Cedars-Sinai Epilepsy Program. "We're not here to say no. We're here to help guide you toward safe and effective healthcare decisions." Some states have legalized recreational use of marijuana, while others have legalized medical marijuana. The law depends on where you live, and whether the CBD comes from hemp or marijuana. But whether or not these products actually contain the amount of CBD they advertise is up for debate, since they're not approved by the FDA. For example, the law precludes manufacturers and distributors from selling mislabeled or adulterated products and it requires manufacture and sale of products consistent with good manufacturing product standards. Most CBD-infused products are marketed as supplements, which are not regulated by the FDA. It seems like everywhere you look, products infused with cannabidiol, better known as CBD, are being advertised as the latest and greatest wellness product. As noted, demonstrating a product's intended use and making disease and health claims are common pitfalls for companies selling CBD products. The Healthy The use of cannabis during pregnancy may have harmful effects on a baby’s health after birth. Research has linked the use of cannabis products with an increased likelihood of developing head, neck, or throat cancer,40 particularly in people who smoke cannabis.41 These effects are more common when a person takes a large amount, the cannabis product is strong (has a high level of THC), or the person has little experience with using cannabis.19,20,21 There is limited research on the health effects delta-8-THC and other intoxicating cannabinoids and related compounds, including delta-10-THC, THC-O-acetate, THCV, THCP, HHC, HHC-O-acetate, HHCP, and CBN. Delta-8 THC products have not been FDA-approved for safe use. Cannabis (and its extracts) marketed as “medical” may contain THC, CBD, or a combination of both, as well as other minor cannabinoids and terpenes. “This modification to income is appropriate because, while the expenses of cannabis-related business cannot be deducted for federal purposes, New York law permits and encourages these businesses akin to any other legitimate business occurring in the State,” a memo attached to the bill says. In June, New York’s Office of Cannabis Management proposed allowing ROs/MSOs to enter the recreational retail market by year-end, reversing itself on the promised three-year waiting period for the state’s 10 vertically integrated medical marijuana providers. The showcases broadened the availability of cannabis products throughout the state and enabled buyers to purchase cannabis products in areas where no retail outlets were open, and where none could open because of litigation that stalled the opening of new retail outlets. January 15, 2024 – PharmaCann is the only medical operator to open a co-located store in the state.Although six cannabis multistate operators were approved by New York regulators to open retail shops, only one has so far taken the plunge. Today, January 26th, the FDA released a statement concluding that the current regulatory framework for food and supplements are simply not appropriate for CBD! Rep. James Comer, the chair of the US House Oversight Committee, commented recently that that the committee desires to question the current FDA Commissioner Robert Califf regarding the agency’s lack of movement on a number of issues, including CBD. In other words, GW Pharmaceuticals may now lawfully distribute CBD made from the buds or leaves of the Cannabis plant; it just can’t produce (or even possess) those buds and leaves here in the United States. Oddly, however, the company likely cannot manufacture the drug yet, at least not in the United States. To be sure, there was some uncertainty over just how far the DEA would go—for example, would it reschedule just Epidiolex, or would it reschedule all CBD based drugs? Even after the approval, the company that makes Epidiolex (GW Pharmaceuticals) still couldn’t lawfully sell it. (Senate Majority Leader Mitch McConnell has proposed legislation that would remove many of these restrictions on hemp, see here, but it remains just a proposal for now.) The FDA’s approval of Epidiolex did not, by itself, make it lawful to possess or distribute CBD under federal law. (The FDA had previously approved two synthetic forms of THC for medical use.) The FDA got the ball rolling in June 2018, when it approved a drug (Epidiolex) made from natural CBD—i.e., CBD extracted from the Cannabis plant (any part). Given these limitations imposed on industrial hemp, I suspect the Agricultural Act does not create much of an opportunity to produce (and especially, to sell) CBD legally. Perhaps most importantly, the Act authorizes only the production of industrial hemp—and then only for research purposes. 'Tis the Season… for Sleepless Nights? Farmers producing hemp primarily for non-intoxicating CBD products fear the legislation will regulate them out of business and hurt the growing CBD industry for health-related products. Lawmakers say that growers and processors exploited the opportunity to formulate products with THC levels equal to those of legal cannabis. Hemp was once considered a controlled substance, but changes in the 2018 farm bill essentially opened the door to hemp-derived products, like paper, clothing and building supplies. In 2018, more than 1,000 companies were producing and marketing CBD products for the U.S. market.133 Since 2014, when total CBD sales were a reported $108 million, U.S. sales of CBD have risen fivefold (Figure 3). Typically, these products contain 0.45% to 1.5% THC, with some products containing up to 9% THC—levels that could result in psychoactive effects by the user.131 If a firm seeks to market CBD as a treatment or an otherwise therapeutic product, the firm generally would need to obtain premarket approval from FDA via the new drug approval pathway.
